A man who drove past the safety barricades last fall as floodwaters filled Brushy Creek has been charged with the death of his passenger, who drowned after the truck was swept away.
Willie Nathan Brite, Jr., 43, was indicted Wednesday by a Caldwell County grand jury on a charge of criminally negligent homicide in the death of Cynthia McKee. Authorities say Brite drove around the barricades the night of Nov. 1, and his truck was submerged in a low water crossing at Brushy Creek on Palonia Road, off FM 2001. Brite was able to escape and told police what happened. McKee's body was found 10 days later.
It was not clear Thursday if Brite was in custody in Caldwell County.
The investigation was conducted by the Caldwell County Sheriff's Office, the Texas Department of Public Safety and the Texas Rangers.
Criminally negligent homicide is a state jail felony punishable by 180 days to 2 years in jail and a fine up to $10,000.
On Wednesday, Brite was also indicted on charges of driving while intoxicated in connection with a Dec. 21 incident where witnesses told police that Brite's vehicle had struck a parked car.

I made a dumb call one time and drove around a barrier and through low water. It was late, we were headed home from the beach (3 hour drive), i wasn't familiar with the roads and was certain that a detour would cost us another 30 minutes at least.
we were fine, but it's still the dumbest move i think i've ever made.

Fine throw him in the can for a few months...but more to the point:
Revoke his license for like a decade. This dude sounds like a dipshit behind the wheel. Sure, we've all done stupid stuff, but negligent homicide followed not even two months later by DWI resulting in hitting a parked car sounds like he could use a little time out...and by "little", I mean "10 years"

We have a creek called Brush Creek in KCMO and sometimes we get heavy rain and it will back the sewers up and dump rain/sewage into the creek. We nicknamed it Flush Creek.
